According to The Federal Fair Labor Standards Act, (FLSA), employers are required to pay overtime wages for work in excess of 40 hours per workweek, subject to specific exemptions. Typically, the overtime wages must be paid at one and one-half times the regular pay rate. What a lot of workers and employers don't realize is that when a worker is paid "by the week" or "by the day" that worker is usually still entitled to that overtime pay.  Commonly, employers will classify workers wrongfully and improperly as "Managers," "Assistant Managers," or "Supervisors" in a deliberate attempt to dodge their legal obligation to pay overtime wages. Many employees classified in this way are NOT exempt from the overtime law and are eligible for overtime pay.
